(Photo: PRD) PATTAYA, Thailand – As a legal professional working with foreign nationals in Thailand, I’ve encountered many stories some frustrating, some eye-opening. But one recurring issue that keeps surfacing is deceptively simple the security deposit that never comes back. It might seem like a small matter, but for many foreigners living in Thailand, it becomes a symbol of mistrust, confusion, and legal vulnerability. Let me share with you one such real case, from my legal clinic. It Started with Trust David (name changed), a European professional working in Thailand’s tech industry, came to my office with a thick file of documents and a visibly frustrated face. He had rented a condominium in the Phrom Phong area of Bangkok through a local property agent. The lease was properly executed, payment made in full, and a two-month security deposit around 36,000 THB was placed, as is standard. He fulfilled the lease, gave timely notice, and returned the unit in good condition. He even took photos of the unit before moving out. And then… silence. The Vanishing Act After vacating the unit, David tried to contact the agent several times. Emails, Phone calls, Messages. No response. No explanation. No argument. Not even a polite excuse. “I don’t understand. I followed the contract. Why are they doing this to me?” he asked, clearly disheartened. Our Investigation Begins As David’s legal representative, we immediately began looking into the matter. From the lease agreement, we confirmed that the landlord on paper was not the agent but a limited company acting as a rental intermediary. Digging further through land office records, we discovered that the actual owner of the unit was a Chinese woman who had not lived in Thailand for years. She had entrusted the unit to this agency, but without a clearly defined power of attorney or written mandate. In short, the agent was acting loosely as an unregulated caretaker with little accountability. Polite First – Then Firm We issued a formal demand letter to the agency, attaching the lease, payment slips, and photos showing the unit’s condition. We requested a response and repayment of the deposit within 7 business days. …Silence… We followed with a second notice, this time warning of legal action if no response was received. Still nothing. When Law Becomes the Last Option With no reply, we filed a claim in the Bangkok Civil Court (Small Claims Division). It was a straightforward case: a valid lease, no damage, no counter-claim. For David, the 36,000 baht wasn’t the issue. It was the principle. He wanted to make it clear: “You may have done this to others before. But this time, you will be held accountable.” What This Case Taught Us This case wasn’t rare. Nor was it about a large sum of money. But it exposed a deeper issue. Many property agents in Thailand operate without oversight. Foreign tenants often don’t know their legal rights and choose not to pursue justice due to inconvenience. Absentee landlords often have no clear control over what their local representatives are doing As a Legal Advisor, My Advice Is This: If you are a foreign national renting a property in Thailand: Always insist on written contracts. Take photos of the unit before move-in and after move-out. If your deposit isn’t returned, don’t hesitate to send a formal demand. And if that fails you can and should sue. Thailand’s small claims court system is efficient and fair. The law should never be feared when it is used with knowledge and fairness. The suspect was dressed in multiple layers of clothing, wearing a helmet, face mask, and a thick jacket to conceal his identity. When police attempted to search him, Permphon resisted arrest and fought briefly, causing minor injuries to officers before being subdued. A thorough search of his backpack revealed the air gun and several clothing items. During questioning, Permphon admitted he had intended to commit the robbery to solve his financial troubles. He had lost his rental money and funds meant for his 7-month-old child’s care through failed stock market investments. His 22-year-old wife, holding their infant child, tearfully visited the police station, expressing sorrow and apologizing on behalf of her husband. She had been unaware of his plans and believed he was merely visiting friends. Police Colonel Anek praised the vigilance of Sergeant Nantawat Sriwiseth for identifying the suspicious individual and preventing a possible crime before it occurred. The suspect is currently charged with resisting arrest and will face legal proceedings. Since then, the 29 year old from Cwmbran, Wales has been battling for his life in a Pattaya hospital after undergoing emergency brain surgery. Family friend Angela Shepherd, speaking on behalf of the devastated family, said the past few weeks had been a “harrowing” ordeal. “We don’t know what happened or how it all started, but we think Ashton got separated from his mates. When they contacted the police, they were told he was in intensive care,” she told BBC Wales. “We believe he was set upon by one or more people who left him for dead.” The Welshman, who had been in Thailand for only a few days after travelling there with two friends, has undergone surgery to treat a bleed on the brain, and part of his skull was removed to relieve pressure. Thankfully, Ashton is now in a better condition and starting to communicate with his family, said Angela. “He’s not out of the woods yet. He’s still being fed through a tube, and oxygen is being administered through another. He’s still restrained to the bed because he gets frustrated, but at least now he’s showing signs of improvement.” Ashton’s recovery has been painfully slow, but his family are doing everything they can to bring him home, Angela added. “We’re just desperate to get him back to Wales. His family has been raising funds to cover his medical costs as he didn’t have travel insurance, and they’re working with a repatriation company to bring him home soon.” The whole family has been in turmoil. Darren, who flew out to be by his son’s side, has been overwhelmed by the support of strangers who have helped him with accommodation and translation at the hospital. “They’ve been a godsend,” Angela said. A British Foreign Office spokesperson confirmed they are in contact with Ashton’s family and local government officials. “We are supporting a British man who has been hospitalised in Thailand and are in contact with his family and the local authorities.” Ashton’s assault is currently under investigation by Thai police, but no further comments have been made at this stage. Upon arrival, responders found a Yamaha Grand Filano motorcycle with Chon Buri registration severely damaged after losing control and crashing into the bridge railing. Despite the emergency team’s efforts, he succumbed to his injuries shortly after. Initial investigations led by Police Lieutenant Nakrob Siriphan, an inspector with the Map Prachan investigation unit, documented the scene. Since no witnesses were present, CCTV footage will be reviewed to determine the cause of the accident. The deceased’s body was taken to Bang Lamung Hospital, awaiting family members to arrange religious funeral rites, reported KhaoSod. In similar news, a 42 year old man lost his life on his birthday after his motorcycle plunged from a 10-metre-high overpass in Nonthaburi, just outside Bangkok. The rider, identified as Seksan (surname withheld), had reportedly been speeding and overtaking a taxi moments before the fatal accident. The incident occurred around 2am on March 21. Officers from Chaiyapruek Police Station and volunteers from the Ruamkatanyu Foundation rushed to the scene on the Chaiyapruek-Ratchaphruek Road overpass in Bang Phlap subdistrict, where they found Seksan’s body lying face down in a garden below.
